Robert E. "B.J." Bell

B.J. has over twenty years of experience as a trial attorney. He has handled a broad range of civil litigation matters over the course of his career with an emphasis on health care litigation, medical malpractice litigation, and commercial/business disputes. B.J.’s work philosophy includes working heartily in all things and striving to be a faithful steward of his clients’ trust, people, resources, and time.

After graduating from Baylor University (Sic’em), B.J. attended South Texas College of Law. During his time at STCL, B.J. competed as a moot court oral advocate and brief writer for STCL’s nationally acclaimed advocacy program. B.J. graduated cum laude from STCL.

B.J. Bell and Will Whitaker have practiced law together since 2006. In 2022, B.J. and Will founded Steward, PLLC d/b/a Whitaker Bell. Together B.J. and Will share a work and life motto of taking next right steps and striving to be faithful in all things.

B.J.’s wife and kids are the joy of his life. The Bells are members of Christ Community Church and B.J.’s kids attend Trinity Classical School. With Ashley, B.J.’s wife, being a Baylor grad as well, the Bells bleed green and gold. For fun you might find B.J. running at Memorial or Terry Hershey Parks, on his bike for a ride, at Covenant Gym (the best Coach and Gym in Houston) or spending time with friends and family.

Relevant Experience

  • In April 2022, defended a health care client in a commercial contract dispute case in Hood County with millions of dollars in dispute. After a weeklong trial, obtained a successful judgment.
  • Defended a hospital in a traumatic birth injury case with over thirty million dollars in alleged damages. Took the case to trial and obtained a successful resolution for the hospital in the middle of trial.
  • Secured multi-million-dollar recovery in managed care dispute for healthcare client.
  • Secured multi-million-dollar recovery for healthcare client arising from health insurer’s failure to timely process claims in connection with its institution of a prepayment review.
  • Defended health care providers in hundreds of health care liability claims over twenty years involving allegations of: birth injury, stroke, cancer, Lasik surgery, nerve injury, infection, decubitus ulcers, compartment syndrome, medication errors, failure to monitor, failure to diagnose, delay in treatment, wrongful death, chain of command, negligent credentialing, negligent hiring, supervision and training, misdiagnosis, and numerous others.
  • Represented a natural gas midstream pipeline company in state district court and before the American Arbitration Association involving a contract dispute with a power plant owned by Direct Energy in South Texas. Successfully obtained a temporary injunction which enjoined the power plant from attempting a wrongful foreclosure sale. Successfully defended the injunction before the Thirteenth Court of Appeals. Although B.J.’s client was sued as the defendant, B.J. obtained a settlement for his client from the plaintiff.
  • Defended a hospital, hospital’s CEO and healthcare entity in a lawsuit brought by a cardiovascular surgeon alleging breach of contract, fraud, business disparagement and other claims. B.J. obtained a summary judgment and successfully upheld the summary judgment before the Texas Supreme Court, with oral arguments before the Supreme Court.
  • Defended a medical products company in a breach of contract lawsuit involving the purchase of radiation therapy machines. Obtained a favorable settlement.
  • Prosecuted a breach of contract lawsuit on behalf of a high-level executive recruiting firm against a global expert services firm for unpaid placement fees for high-level executives. Obtained a favorable settlement.
  • Defended a hospital in a medical negligence case in federal district court where the plaintiff alleged infection from a neurosurgical procedure. The hospital’s three co-defendants paid settlements totaling millions of dollars. B.J. obtained summary judgment and complete dismissal for the hospital.
  • Defended several online travel companies in lawsuit brought by City of Houston and Harris County Sports Authority regarding hotel occupancy taxes. Successfully obtained summary judgment for the online travel companies, which was affirmed on appeal.
  • Defended a company where plaintiff claimed to have sustained an injury from an alleged malfunctioning elevator. Obtained a dismissal.
  • Defended company where plaintiff claimed to have sustained an injury from malfunctioning automatic sliding doors. Obtained a dismissal.
